1. Who we are
Luxury Property Studio ("we", "us", "the Studio") is a Netherlands-based business producing AI-generated video content for luxury short-term rental properties, based on photos supplied by the property owner or manager ("you", "the client").
2. The services we provide
We offer two video formats:
- Walkthrough: one continuous video moving through the property.
- Shot Compilation: a set of standalone showcase clips.
Both are produced using AI video generation tools based on the photos you provide. We do not send a film crew to your property.
3. Your photo submissions
By submitting photos to us, you confirm that:
- You own the photos or have the right to use and share them.
- You have the right to authorize us to process them using AI tools to create video content.
- Any people appearing in the photos have consented to their image being used, or the photos do not contain identifiable people.
You grant us a license to process your submitted photos solely for the purpose of producing your ordered video. If any of the above confirmations turn out to be untrue and this results in a claim against us, you agree to compensate us for any resulting costs or damages.
4. Revisions
One round of revisions is included with every project, covering adjustments to pacing, music, or minor details. Additional rounds of revisions beyond the first are billed at €50 per round. Requests for a completely different format or scope (e.g. switching from Shot Compilation to Walkthrough) are treated as a new project.
5. Delivery & turnaround
Typical delivery time is 3–5 business days from when we receive your complete set of photos, depending on the format and number of rooms included. Turnaround times are estimates, not guarantees, and may vary based on current workload.
6. Payment
Full payment (100%) is due upfront via bank transfer before production begins. If a client prefers a different payment method, this can be arranged on a case-by-case basis. Prices shown are as listed; VAT will be added where applicable once we are registered for VAT.
7. Usage rights
Once paid in full, you receive a license to use the delivered video for your own property listing, marketing, and social media. Luxury Property Studio retains the right to feature the video in its own portfolio and marketing materials, unless you request otherwise in writing.
8. Ownership of AI-generated content
The video we deliver is generated using third-party AI tools based on your submitted photos. Copyright ownership of AI-generated content is a developing area of law and can vary by jurisdiction and by the terms of the underlying AI tool provider. We grant you full rights to use your delivered video as described above; we do not claim ownership over your original photos.
9. Accuracy & platform compliance
You are responsible for ensuring that the final video is a fair and accurate representation of your property, in line with the accuracy requirements of platforms such as Airbnb. We aim to produce video that reflects the photos you provide, but final responsibility for listing accuracy rests with you as the property owner or manager.
10. Liability
Our video content is generated using AI tools and is intended for promotional use. To the fullest extent permitted by law, our liability for any claim relating to our services is limited to the amount you paid for the relevant project. We are not liable for indirect or consequential losses, including lost bookings or lost profits, or for platform policy changes and decisions guests make based on the video. Nothing in these terms limits liability that cannot be excluded under Dutch law, such as liability arising from intent or gross negligence.
11. Cancellations & refunds
Before production starts: if you cancel your project before we begin AI production on your photos, your payment is refunded in full, minus a €50 administrative fee.
After production has started: once production has started, your payment is non-refundable, since it covers the AI processing and editing work being carried out.
If you're not satisfied with the result: quality concerns are handled through revisions rather than refunds in most cases — see the Revisions section above for what's included. If we're genuinely unable to deliver a usable video from the photos provided, we will offer a full refund of any payment made for that project.
Right of withdrawal: under EU consumer law, the standard 14-day right of withdrawal for online purchases does not apply once we've begun producing custom, personalized content at your request.
Requesting a cancellation or refund: email hello@luxurypropertystudio.com with your name and project details. We aim to confirm cancellations and process any applicable refund within 3 business days.
12. Governing law
These terms are governed by the laws of the Netherlands.
